These are the terms for using Mokxi: the site at mokxi.com, the editor, the simulator, the lessons, the classes and everything else we run there. Mokxi is operated by Mokxi LLC, a Colorado limited liability company ("we", "us"). By using Mokxi you agree to these terms. If you do not agree, do not use it. ## 1. Who can use Mokxi You need to be 13 or older to make an account on your own. A student under 13 may have an account only with consent, given in one of two ways. Through school: the school consents on the parents' behalf, for the school's educational purpose only, under its Student Data Privacy Agreement with us or, until one is signed, through the teacher who sets up the class acting for the school under these terms and the student data privacy notice at /privacy/students. Outside school: a parent or guardian consents by writing to us from their own email address, and we confirm it with them before the account is used. Anyone may use the editor without an account. If you are using Mokxi for an organization, you are agreeing on its behalf and you need the authority to do that. ## 2. Your account You can use the editor with no account at all. An account lets you save projects, share them, join classes and pay for a plan. Keep the sign-in to your account to yourself and tell us right away if you think somebody else has it. What is done from your account is your responsibility until you tell us. One account is one person; a class is the way to give a group of people access. ## 3. Plans, payment and refunds The Free plan is the whole simulator, with limits on how much you can save. Pro, the student plan, Teacher and Classroom are paid monthly or yearly, in advance, through Stripe. A paid plan renews at the end of each period until you cancel it. You can cancel any time from your account page or by asking us; you keep the paid features to the end of the period you paid for, which your account page names as a date, and there is no further charge. If a payment fails we do not switch anything off while the card is being retried, and we say so on your account page. If a first payment was a mistake, ask within 14 days and we refund it in full. After that, and for renewals, we do not refund a period already started, except where the law where you live says we must. If we raise a price, we tell account holders on that plan by email at least 30 days before it applies to them. The student plan is for people who can show they are a student, by a school email address or another check we offer. If a check fails or the eligibility ends, the plan moves to the ordinary Pro price at the next renewal, and we say so first. The Teacher plan is one price for one teacher with forty student seats included, across the classes that teacher runs; it is not shared between teachers. More than forty students, several teachers or a whole school is a Classroom plan, sold by a written quote and priced per student as the quote says; the teacher’s own seat is not charged for, and the number of students can be changed at any time from the account page, with the part of the period worked out by Stripe. Invites: every account that is not in a class as a student has an invite link. When somebody signs up with your link, confirms their sign-in and saves a circuit to their account, you both get 7 days of Pro, for up to 5 friends per account. The days are added to any Pro time you already have from a trial or an invite; if you are on a paid plan they wait and start when it ends. One account is one person: accounts made to invite yourself do not count, and we can take back days earned that way. Invites are by link only; you never give us anyone else's contact details. We may change or end the invite program, and days already granted stay yours. ## 4. Your projects are yours Everything you draw and write in Mokxi belongs to you. We store it so you can get it back, and we do not claim any rights over it. So that we can run the service, you give us permission to keep copies, to show a project to the people you share it with, and to run it in their browsers. That permission ends when you delete the project, except for copies other people made while it was public. A project you make public can be opened, run, copied and changed by anyone on Mokxi, and that is the point of making it public. A project you submit to a class can be seen by the teacher of that class. Private projects are seen by you, by the people you give a link to, and by us only when we need to fix something or the law requires it. The built-in projects, the lessons and the parts are ours. You may use them inside Mokxi freely, in your own work and in your classes, including screenshots and exports of circuits you build from them. ## 5. What you agree not to do - Attack, overload or probe the service, or get around a plan limit, a rate limit or an access check. - Put anything unlawful on Mokxi, or anything that infringes somebody else's rights. - Harass anyone, in a collaboration room, a class or a shared project. - Collect other people's information from Mokxi, or use it to send them anything. - Sell access to Mokxi or pass off any part of it as your own. ## 6. Schools and classes A teacher who sets up a class is responsible for who joins it, for being allowed by their school to use Mokxi with their students, for the school having the permissions it needs from parents and guardians, and for what the class submits. A student's work in a class is visible to the teacher of that class. When a class is closed, its roster and submissions are deleted, and each student keeps their own projects in their own account. We sign school and district student data privacy agreements; where a school has one with us, it governs the school's student data and wins over these terms where the two differ. How we handle student data is set out at /privacy/students. ## 7. It is a simulation Mokxi is a simulator, and it is not a substitute for building the circuit. It will get some things wrong, and a circuit that works here can still fail, overheat or damage a part on the bench. Check your work, especially anything you connect to wall power, a battery of any size, a motor or another person, before you power it. Do not rely on Mokxi for anything where a mistake could hurt someone. ## 8. Our software The simulator, the CPU cores, the parts, the boards, the site and the Worker are ours, and we wrote them. You get a license to use them through Mokxi. The parts that run in your browser are there to be run; you may not copy them into another product, remove our notices, or build a competing simulator from them. Mokxi and the Mokxi mark are ours to use. ## 9. Changes and availability We change Mokxi all the time and we will keep doing so. We can add, change or remove features, and we can stop offering a plan. If a change takes away something you pay for, we tell you first and you can cancel with a refund of the unused part of your period. We aim to keep Mokxi up, but we do not promise it, and it will sometimes be down for maintenance or for reasons outside our control. You can export any project as a file at any time. ## 10. Ending things You can close your account whenever you like from your account page; that deletes your projects and your data as the privacy notice describes. We can suspend or close an account that breaks these terms, that attacks the service or that hosts something unlawful, and we will say why unless the law stops us. Sections 4, 7, 8, 11 and 12 keep applying afterwards. ## 11. No warranty, limited liability Mokxi is provided as it is and as available, with no warranty of any kind, whether written, implied or from how it is used, including any warranty that it is accurate, fit for a purpose, or free of faults. To the extent the law allows, we are not liable for any indirect, incidental or consequential loss, for lost data, lost profit or lost time, or for anything you build from a simulation. Our total liability to you for anything to do with Mokxi is limited to the amount you paid us in the twelve months before the claim, or fifty US dollars if you paid nothing. Some places do not allow some of these limits, and where that is so they apply only as far as the law allows. ## 12. The law that applies These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules, and any dispute goes to the state or federal courts in Colorado. Either side can also bring a claim in a small claims court that has jurisdiction. If you live in a place whose consumer law gives you more than this, that law still applies to you. ## 13. Changes to these terms When we change these terms we change the date at the top. For a change that matters to you, we tell account holders by email at least 14 days before it applies.
